To the fullest extent permitted by law, you expressly release, waive, and forever discharge, and you covenant not to sue, and you waive all rights to bring or maintain any claim against any individual Protected Party (including any individual expert, coach, contractor, or staff member) arising out of any advice, content, support, seminar, class, session, message, or communication — whether 1:1 or group-based, and whether provided via video, phone, chat, email, social media, or otherwise.

• Any "right-time steps" or guidance you choose to follow is done at your sole discretion and entirely at your own risk.
• Experts are educators and support providers — not your licensed healthcare team.
• This shield applies even if the expert holds professional credentials in another jurisdiction.

• Educational & Entertainment Only: Any informal guidance, suggestions, tips, scripts, templates, sample routines, or responses provided via chat, concierge, or other messaging channels are provided solely for entertainment and educational purposes and are not instructions, directives, or individualized professional advice.

You acknowledge and agree that:

• Parenting, infant care, sleep routines, feeding practices, and developmental guidance involve inherent and unpredictable risks.
• The use of baby products involves inherent risks including, without limitation, choking hazards, allergic reactions, injury, misuse, and other known and unknown risks.
• You voluntarily and expressly assume full responsibility and all risks of any kind, whether known or unknown, foreseeable or unforeseeable, arising out of or relating to your reliance on any Waivy Baby content or guidance, and/or your child's use of or exposure to any product.
• You are solely responsible for your child's supervision, environment, decisions, and care, and for determining what is safe and appropriate for your child's specific needs and developmental stage.

No Guarantees / No Outcomes Promised: Waivy Baby does not and cannot guarantee any specific results or outcomes, including outcomes related to sleep, feeding, routines, temperament, health, growth, development, behavior, milestones, or parental wellbeing. Testimonials, past results, and success stories are not guarantees of future results.

To the fullest extent permitted by law, you agree to indemnify, defend (with counsel acceptable to Waivy Baby), and hold harmless all Protected Parties from and against any and all claims, demands, causes of action, liabilities, damages, judgments, settlements, penalties, fines, losses, costs, and expenses (including attorneys' fees, expert fees, and court costs) arising out of, resulting from, or relating to:

• Your access to or use of the services, content, communications, or products;
• Your reliance on any guidance, suggestions, or information provided by Waivy Baby or any Protected Party;
• Any act, omission, decision, or conduct by you or anyone under your care or control (including your child, partner, caregiver, or household);
• Your breach (or alleged breach) of this Disclaimer;
• Any allegation of injury, harm, loss, or damages (including bodily injury, death, emotional distress, developmental concerns, or property damage) involving you or your child; and/or
• Your violation of any law, rule, regulation, or the rights of any third party.

This indemnity includes the obligation to pay all defense costs as they are incurred. Waivy Baby reserves the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate fully.

IN NO EVENT SHALL WAIVY BABY LLC, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR EXPERTS, BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages;
• Loss of profits, data, use, goodwill, or other intangible losses;
• Damages resulting from your access to or use of (or inability to access or use) the Services;
• Any conduct or content of any third party on the Service; or
• Any content obtained from the Service.

These limitations apply even if Waivy Baby has been advised of the possibility of such damages and even if any limited remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations — in such cases the limitations apply to the maximum extent permitted.
